This is a legally binding agreement between you (“Participant”) and the Organiser establishing the terms and conditions under which you are entitled to participate in the lucky draw (the “Draw”).
By participating in the Draw, you agree to be bound by and to comply with these terms and conditions including all amendments, additions, replacements and modifications hereto as may from time to time be made by the Organiser. The Organiser reserves the right to refuse entry or refuse to award the prizes to anyone in breach of these terms and conditions or as determined under its sole and absolute discretion.
If you have collected a prize but do not comply with the terms and conditions for the Draw, you will also be required to return the prize to the Organiser.
1. Organiser
The organiser of the Draw is Endowus Singapore Pte. Ltd (“Endowus”).
2. Name of the Draw
The name of the Draw is Endowus Year End Lucky Draw 2023.
3. Date, Place and Time of the Draw
There will be 2 rounds of draw based on 2 Qualifying Periods:
The draw for each round will take place at our offices (158 Cecil St, #08-01, Singapore 069545) with a public accountant present. The date and time for each round of the Draw is as follows:
4. Eligibility for the Draw
Subject to the exclusion below, to be eligible for each round of the Draw, you must be an invested client of Endowus at the applicable cut-off date for each round (an “Eligible Participant”). An “invested client” refers to an individual or joint account client who has invested a minimum of $1,000 in any products offered on the Endowus, as determined at the applicable cut-off date for each round. To avoid doubt, each joint account shall count as one Eligible Participant.
The Organiser and its affiliates, as well as sponsors, agencies or other persons (including, without limitation, any external auditor(s) and advertising agencies) who are involved in organising the Draw as determined by the Organiser, and the employees of such persons, shall not be eligible for the Draw and shall not be considered Eligible Participants.
The Organiser shall have absolute discretion to decide on the eligibility for participation in the Draw.
5. The Rules of the Draw
Each Eligible Participant is given a number of chances to win a prize at each round of the Draw based on Qualifying Action(s) taken by the Eligible Participant during each Qualifying Period, and corresponding to the table below:
A “Successful Referral” occurs when (i) an Eligible Participant refers a new customer (“Referee”) to open an account with Endowus using your personal referral link provided by Endowus AND (ii) the Referee invests a minimum of S$1,000 in any products offered by Endowus using that newly opened account during the Qualifying Period. To avoid doubt, the Referee must not have previously opened an account with Endowus, or be in the process of opening an account with Endowus, prior to the referral by the Eligible Participant.
An Eligible Participant may earn Qualifying Chance(s) through more than one Qualifying Actions. There is no limit to the number of Qualifying Chances that an Eligible Participant may earn through Successful Referrals.
During each round, one Eligible Participant will be selected at random to receive a prize (a “Winner”) by the Organiser using the Organiser’s operating software. The number of chances that the Eligible Participant has for each round will depend on the number of Qualifying Chance(s) that he/she has.
The result of the Draw will be published on the Endowus Year End Lucky Draw web page. If you are a Winner, you will be contacted via your Endowus registered email within 7 days of the result for each round. If we do not receive any response after 14 days of notification or otherwise do not comply with the terms and conditions of the Draw, you will be deemed to have forfeited your prize, and the Organiser may select another Eligible Participant at random for the prize. The substitute Winner will in turn be contacted within 7 days of the forfeiture by the original Winner and the same terms and conditions herein shall apply to the substitute Winner. Any prize left unclaimed thereafter will be forfeited and may be disposed of in any manner at the discretion of the Organiser.
If you do not win at the first round, you will automatically qualify for the next round based on the number of Qualifying Chance(s) which you have accumulated in both Qualifying Periods. Conversely, if you are a Winner in the first round, you will not be eligible to take part in the second round.
The decision of the Organiser regarding any aspect of the Draw is final and binding and no correspondence will be entered into about it. The Organiser reserves the right to hold void, cancel, suspend, or amend the Draw at its sole and absolute discretion.
6. Prizes
The prizes are non-exchangeable, non-transferable and no cash alternative will be offered. Where prizes contain a specific date during which the prize should be utilised, no requests for extensions or replacements whatsoever will be entertained. The prizes may be subject to additional terms and conditions, and a Winner agrees to comply with all terms and conditions applicable to the prizes.
7. Personal Data
By participating in the Draw, you agree that any and all personal data submitted may be collected, used and/or disclosed by the Organizer and its authorised third parties for the following purposes: (i) processing and administering matters relating to the Draw, including communicating with you and/or any third parties sponsoring the prizes for purposes related to the Draw and the Organiser’s legal, operational and business needs; (ii) publication of the result of the Draw on the Organiser and/or its affiliate’s website; (iii) promotion or advertising purposes in relation to the Draw and/or Conference; (iv) to comply with any applicable law in relation to the conduct of the Draw; and/or (v) such other purposes as the Organiser may reasonably deem appropriate, or in relation to which you have otherwise provided or have been deemed to have provided the Organiser with consent, or as otherwise permitted by applicable law.
8. General Terms and Conditions
The Organiser, its representatives and/or agents will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize or participation in the Draw except where it is caused by the gross negligence of the Organiser, its representatives and/or agents. To the maximum extent permitted by law, you agree to indemnify the Organiser against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with your participation in the Draw. The terms and conditions of the Draw are not intended to confer rights to any third party under the Contracts (Rights of Third Parties) Act 2001 to enforce any provision of these terms and conditions, and the operation of the said Act is hereby excluded. The terms and conditions of the Draw are governed by Singapore law and you agree to submit any claim, dispute or controversy to the exclusive jurisdiction of the courts of the Republic of Singapore.
